Temporary Award Flexibility Schedule Inserted into the Real Estate Award

The Full Bench of the Fair Work Commission has varied the Real Estate Award in response to the COVID-19 pandemic by adding a new Schedule I to apply from an employee’s first full pay period commencing on or after 6 August 2020.

The Schedule applies to employees who were employed as a commission-only salesperson as at 6 August 2020.  An employee who is not employed as a commission-only salesperson as at 6 August 2020, is not eligible to be employed on a commission-only basis prior to 1 November 2020

The Full Bench considered the insertion of Schedule I to be appropriate to allow the months of May to October to be disregarded for the purpose of determining whether commission-only employees have met minimum income threshold amounts (MITA).
